Zipcar ‘the big hand’ competition terms and conditions
This competition (the "Competition") is organised by Zipcar UK Inc. ("Zipcar”).
By entering into the Competition, the entrant agrees to be bound by:
these Terms and Conditions connections;
any other requirements or instructions provided to the entrant at any stage by Zipcar (via its Websites or otherwise);
To receive email communications from Zipcar unrelated to this Competition; and
a grant of a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to Zipcar to use any material submitted as part of the Competition and any publicity materials generated as a result of the Competition.
If you do not agree to these Terms and Conditions, please do not enter the Competition.
By entering the Competition, the prize winner consents to their name, age, photo, videos, submissions for the Competition being used on Zipcar's Websites at any time, and to any other promotional activity as requested by the Zipcar, including social media and similar promotional activities. All entrants to the Competition must be at least 21 years of age at the date of entry and must comply with the following further eligibility requirements:
Entrants must be UK residents;
Entrants must hold a valid driving licence; and
Winning the competition is contingent upon the entrant meeting the Zipcar membership eligibility criteria as detailed here. Any non-member entrant selected as a winner who fails to meet the eligibility criteria will be disqualified and Zipcar shall select an alternative winner. Any non-member entrant selected as a winner who meets the eligibility criteria shall be provided with a free Zipcar membership as part of the prize.
This Competition excludes employees and their immediate families of Zipcar.
Proof of age, address and Zipcar membership eligibility is required before a prize winner can claim the prize. The eligibility of any entrant is at the sole discretion of Zipcar. It is the responsibility of the entrant to ensure they meet all eligibility criteria and can provide any required evidence of their eligibility.
Multiple entries are permitted, so long as each entry consists of a separate idea, but anyone attempting to spam or otherwise exploit this rule will be disqualified.
To enter this competition, entrants are required to submit (online here) a written submission of no more than 200 words and supporting image that:
Outlines how they would use the prize should they win;
Represents the Zipcar mission of enabling simple and responsible urban living; and
Proposes an idea that benefits their local community while making good use of the Zipcar fleet.
Proposes an idea that takes place in a UK Zipcar city.
Entry into the competition is open to both members and non-members of Zipcar UK; purchase of a Zipcar membership is not necessary to enter the Competition.
All entries must be received by midnight GMT on June 20, 2012.
Zipcar reserves the right to remove entries from the vote based on submission suitability and alignment with Zipcar’s core value of enabling simple and responsible urban living. Any entry that, in the sole opinion of Zipcar, is considered inappropriate, obscene, indecent, hateful, tortuous, defamatory, slanderous, libelous, objectionable, promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, age or any other status protected by law will be deemed ineligible, or is otherwise objectionable will be ineligible. Entrants must be the sole copyright owner of the entry submitted and the entry must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement. All entries and materials submitted become the property of Zipcar and will not be acknowledged or returned. The entry cannot have been submitted previously in a promotion or contest of any kind or exhibited or displayed publicly through any means previously. The entry must not contain brand names or trademarks with the exception of the Zipcar brand or trademarks. The entry must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the entry is created.
All Competition entries must be made in accordance with these Terms and Conditions. Entries made otherwise will not be accepted.
Zipcar accepts no responsibility or liability for any lost, delayed, damaged, or invalid entries.
All entries are subject to Zipcar approval based upon the criteria set forth in Section 6. Those entries approved will advance to the voting stage of the Competition.
The winner will be determined by the most public votes gained on the “Big Hand” application tab located on Zipcar’s Facebook page, from June 05 to June 27. The prize winner will be announced no later than June 30, 2012.
The prize of this Competition is:
Winner entitled to Zipcar’s support (as detailed in Section 12) to realise the goals of their project as outlined in their winning entry;
Coverage of their final project on Zipcar Websites. Total value of the prize shall not exceed £2,000.
Zipcar support shall consist of:
Financial support. Zipcar shall purchase third party goods and services up to a value of £1,000 in order to realise the goals of the project.
Logistical support. Zipcar shall provide the winner, at Zipcar’s sole discretion, with logistical support to help plan their project. This support shall include at least one in-house meeting. The onus for organization and planning, nevertheless, lies primarily with the winning entrant. In addition, and entirely at Zipcar’s discretion, Zipcar may provide volunteers drawn from Zipcar’s employee and member bases to assist with the project execution.
Fleet support. Zipcar shall provide the winner (and any additional Zipcar members as required) with sufficient driving credit to cover at least 48 hours access to one Zipcar, subject to availability. At the discretion of the company, Zipcar shall also provide additional credit to cover the usage of additional vehicles in order to realise the project goals.
The prize is non-transferable and non-negotiable and shall ideally be used before 31 July and in any event before 31 August 2012. The project should ideally take place on a weekday in order to ensure vehicle availability. No prize substitutions or cash equivalent of prize is permitted.
Zipcar reserves the right at its sole discretion, and without prior notice:
to substitute or vary the prize (but will not substantially limit the availability or reduce the value of the prize) at any time prior to the prize being won; and
to cancel, postpone or vary the Competition, as Zipcar may deem necessary due to circumstances beyond its control or otherwise.
Use or enjoyment of the prize may be subject to further conditions or restrictions, which will be notified to you as applicable.
Where applicable, all costs incurred in entering into the Competition or using or enjoying the prize, such as any taxes, administrative costs or insurances are (unless specifically stated otherwise) to be paid by the prize-winner.
The prize-winners will be notified by email or telephone no later than 30 June at 6pm.
In order to claim the prize, the prize winner will be required to execute such documentation as Zipcar may require, including without limitation a consent to the use of the prize winner's name and likeness and all of the foregoing materials by Zipcar in any and all promotional and marketing efforts in any media that Zipcar may undertake now or in the future. If the prize-winner fails to claim their prize by July 08 2012, Zipcar may, at its sole discretion, select an alternative prize-winner.
Zipcar's decision as to any aspect of the Competition or these Terms and Conditions is final, and no correspondence will be entered into.
The terms and conditions of any third party supplier involved in this Competition and the prize may apply and must be accepted and complied with by the prize winner to claim the prize.
Subject to clause 22, and so far as permitted by law, Zipcar (and its licensors, affiliates, or promotion partners) excludes all liability for any of following, under any circumstances:
any direct or indirect damages or losses (whether arising in contract, tort (including negligence) breach of statutory duty or otherwise) suffered by an entrant as a result of their participation, or inability to participate, in the Competition;
the entrant's costs incurred in taking part in the Competition or taxes due as a result of accepting the prize; and
Liability arising under any implied warranties, conditions and representations, which are excluded from these Terms and Conditions to the fullest extent permissible by applicable law.
Nothing in these Terms and Conditions limits or excludes, or will be deemed to limit or exclude, Zipcar's liability for fraudulent misrepresentation, death or personal injury caused by its negligence or liability that may not otherwise be limited or excluded by law.
If any of these terms in these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable then such term shall be deleted from these Terms and Conditions, and the remaining terms shall survive and remain in full force and effect.
These terms and Conditions shall be governed by English law. Any dispute shall be subject to the exclusive jurisdiction of the English courts.
